FY12 National Defense Authorization Act


On May 11, 2011, Rep. Todd Russell Platts (R-PA), co-chair of the Congressional Brain Injury Task Force, working in collaboration with the office of Congresswoman Gabrielle Giffords (D-AZ), Task Force members and the Brain Injury Association of America, introduced an amendment to the National Defense Authorization Act that authorizes $1 million for the development of treatment guidelines for post-acute rehabilitation of traumatic brain injury. The amendment was adopted en bloc by the Full House Armed Services Committee by voice vote.


Despite the many advances in science and medicine, medical treatment guidelines for post-acute rehabilitation of moderate and severe TBI do not exist. Currently, there is no compilation of the published evidence and professional consensus to ensure that wounded warriors and the 1.7 million civilians who sustain brain injuries in the U.S. receive the highest quality, most effective post-acute rehabilitation.


“The absence of treatment guidelines contributes to the substantial inconsistencies in health insurance coverage for TBI care, said Dr. Brent Masel, national medical director for the Brain Injury Association of America, adding “the inconsistencies make it difficult for people to get the care they need to live healthy, independent and productive lives.”


The inconsistencies in insurance coverage also create a challenge for the U.S. Department of Health and Human Services. The Patient Protection and Affordable Care Act charges the agency with writing regulations for essential health benefits based on a “typical employer plan.” Since there are no typical insurance plans for TBI, advocates argue the essential benefits for rehabilitation should be based on standardized treatment guidelines that reduce long-term disability and mitigate against the chronic disease processes that result from a traumatic brain injury. 


BIAA would like to thank our congressional partners in this effort including, Congressmen Platts and Pascrell, the office of Congresswoman Giffords and the House Armed Services Committee. BIAA will continue to follow the provision throughout the process of passing the FY12 National Defense Authorization Act and alert grassroots advocates if any action becomes necessary.

Appropriations Update

House appropriators are poised to begin considering their draft fiscal year 2012 spending measures later this month. In preparation, BIAA and NASHIA worked with the Congressional Brain Injury Task Force to issue a letter of support to appropriators urging them to preserve funding for both programs authorized by the TBI Act and the TBI Model Systems of Care Program.

BIAA is monitoring the appropriations process closely and will alert grassroots advocates if action becomes necessary. 

Health Care Reform Update

AHRQ Comparative Effectiveness Review

As some of you may know, BIAA submitted commentsto the Agency for Healthcare Research and Quality (AHRQ) in response to their request for public input regarding an upcoming Comparative Effectiveness Review on Postacute Rehabilitation for Moderate to Severe Traumatic Brain Injury in Adults.

 

On April 19, 2011, in response to its submission, AHRQ contacted BIAA to solicit expertise in developing a Technical Expert Panel (TEP) to advise the agency on its approach to the review. BIAA is pleased that AHRQ is interested in including many perspectives and is encouraged by its willingness to include all stakeholders.

 

BIAA will continue to follow the process of the review and update advocates on the progress of the project.

 

Community First Choice Option

On Tuesday, April 26, 2011, BIAA offered commentsto the Centers for Medicare and Medicaid Services’ (CMS) proposed rule for the Medicaid Program: Community First Choice Option, a program authorized by the Patient Protection and Affordable Care Act.

 

BIAA expressed support for the consumer control and patient-centered planning processes that support participants as the central decision-maker in a long-term services and supports system.

 

However, BIAA also pointed out that the stringency of the eligibility criteria for the program may be detrimental to persons with brain injury because some states use nursing home level of care assessments that do not acknowledge that individuals may not be able to conduct activities of daily living without cueing or compensatory strategies. Because these states base functional assessment on direct caregiving needs, they may exclude people with brain injury.

 

BIAA will continue to monitor the implementation of this program and update advocates as information becomes available.

 

State Health Benefit Exchanges

On May 2, 2011, BIAA joined with over 50 national organizations to submit a letter to the House of Representatives urging them to oppose HR1213, legislation that would repeal the mandatory funding being provided to states under the health care reform law to establish health benefit exchanges.

 

The letter contends that “ The creation of state-based American Health Benefit Exchanges is a central element of the ACA’s provisions to make affordable, high-quality health insurance coverage available to American consumers. Exchanges will provide individuals and small

businesses with competitive, consumer-centered marketplaces for purchasing private health insurance, giving them greater choice at a better price than they can currently receive on their own.”

 

BIAA is monitoring HR1213 closely and will alert grassroots advocates if action becomes necessary.

 

TRICARE Coverage of Cognitive Rehabilitation Therapy

 

On April 19, 2011, BIAA and the Wounded Warrior Project (WWP) met with Senate and House staff to discuss next steps in allowing medically retired service members access to the same brain injury care, including cognitive rehabilitation therapy (CRT), as those on active duty. As many of you know, TRICARE is currently contracting with the Institute of Medicine (IOM) to study the efficacy of CRT with results expected next year.

 

BIAA recognizes the positive steps that TRICARE has taken to make this critical care available and looks forward to Congress facilitating communication with TRICARE Management Authority (TMA) to work towards interim access to CRT.

Obama Funds the HRSA State Grant Program

This morning President Obama released his FY 2011 budget. Last week, the State of the Union address warned of spending freezes and tough decisions on what programs to keep and what programs to discontinue in the coming year. 

BIAA is pleased to announce that the HRSA state grant program, authorized by the TBI Act, has been level funded in the President's budget. 

Although the appropriations process for 2011 is far from over, we are off to a good start.  BIAA would like to make a push for increased appropriations for this program at the 2010 Brain Injury Awareness Day on March 17th on Capitol Hill.  Please contact Sarah D'Orsie, Director of Government Affairs, BIAA at sdorsie@biausa.org if you are planning to attend.

BIAA Health Care Reform Update

After the devastating Massachusetts special election, House and Senate leaders are expected to resume negotiations this week to attempt to finish the health care overhaul. Although a clear path is still unknown, BIAA will continue to monitor the situation closely. A big thank you to all of our grassroots advocates who answered the call last week to urge members of Congress to push forward on Health Care Reform!

State Concussion Legislation

Following the extraordinary success of BIA of Washington and BIA of Oregon in the adoption of state level sports concussion legislation, BIAA, in partnership with the Sports Legacy Institute, has become committed to encouraging, and assisting wherever possible, the enactment of sports concussion legislation in all states.

BIAA has developed a sample piece of legislation based on current laws and pending bills that exist throughout the country. This model legislation along with a sample testimony for use in state concussion hearings, distributed on January 25, 2010 to BIAA’s state affiliates, is a step foward in facilitating action in each state. 

Due to the increased visibility of sports concussions within the National Football League in recent weeks, BIAA is encouraged that all states will be able to tip the scales in favor of protecting our youth athletes.

Brain Injury Awareness Day 2010

This year’s Brain Injury Awareness Day on Capitol Hill is set to take place on March, 17, 2010. BIAA will be unveiling our 2010 legislative agenda and encouraging the grassroots community along with state affiliates to participate in advocating for increased TBI Act appropriations, increased access to care, federal and state level concussion legislation, increased TBI research, military coverage of cognitive rehabilitation and caregiver assistance. 

All issues mentioned will be outlined in fact sheets that advocates will receive that day and can use as reference during congressional visits and may leave behind for review by congressional staff.

Below is the schedule of events for the day:

Over the past week, you may have seen news reports suggesting that health care reform is in serious jeopardy. WE MUST INSIST THAT CONGRESS COMPLETE HEALTH CARE REFORM NOW!

Too many Americans with disabilities and chronic conditions are not well served by the current system and will make tremendous gains through enactment of health care reform.

Take action NOW! Starting TODAY and continuing until the final votes on legislation, call your members of Congress and tell them NOT TO GIVE UP ON AMERICANS WITH DISABILITIES AND CHRONIC CONDITIONS! TELL THEM THAT YOU WANT THEM TO CONTINUE FIGHTING FOR HEALTH CARE REFORM!!!


  • Health care reform will end discrimination based on health status in the private market - discrimination that currently leaves millions of vulnerable Americans uninsured
  • Health care reform will include new, affordable voluntary long term care insurance coverage—the CLASS Act—and expand Medicaid coverage for home and community based services
  • Health care reform will expand Medicaid eligibility and provide subsidies in the private market, creating more affordable coverage for people with disabilities
  • Health care reform will prohibit annual and lifetime limits on coverage so that individuals with serious conditions will not be forced into medical bankruptcy

Health care reform at the federal level is officially on hold. Republican Scott Brown gained the Massachusetts seat vacated by the death of Edward Kennedy, thereby breaking the 60-vote majority in the Senate. Democrats met privately in the days following the Massachusetts special election but were unable to cultivate a strategy for moving forward at this time. A six‐week break is planned, and it is likely policymakers will be forced to accept a substantially scaled‐back package or abandon health care reform altogether.

The Brain Injury Association of America is deeply disappointed. Through our partnership with the Brain Injury Business & Professional Council, we made important gains in the proposed legislation. We cannot forgo this progress; we cannot quit now. We will continue to fight for access to the full continuum of brain injury treatment.

On January 24, 2010, Dateline NBC aired the compelling story of Patrick Gannon,
a man who battled a severe anoxic brain injury and was then forced to wage war against his insurance company. The Dateline story accurately portrays how the health care system victimizes patients and families when they are most vulnerable.

I urge brain injury advocates everywhere to watch Patrick’s story and then write to Ann Curry, Dateline correspondent, to thank her for bringing national attention to the extraordinary challenges individuals with brain injury and their families face. I urge advocates to share their own stories with Ms. Curry and ask that she continue to educate the public about the rehabilitation needs of people with brain injury after their lives have been saved.
